TERMS OF SERVICE
These Terms of Service (“Agreement”) govern the use of marketing services, websites, and related assets provided by Landing Page Kingz (“Agency,” “we,” “our,” or “us”) to any client, user, or visitor (“Client,” “you,” or “your”) engaging with our services. By accessing or using our website or entering into a service agreement with us, you agree to the terms outlined below.
If you do not agree to these Terms, do not use our website or services.
Landing Page Kingz provides digital marketing services including, but not limited to:
- Paid Advertising (Meta, Google, TikTok, etc.)
- Email Marketing Campaigns & Automations
- Landing Page & Website Design
- CRM Setup & Automation (e.g., GoHighLevel)
- Local SEO & Lead Generation
Services are customized per client and defined in individual scope agreements.
- All service fees must be paid upfront, unless otherwise agreed in writing.
- Late payments are subject to a 5% late fee after 5 calendar days.
- Projects may be paused or terminated for non-payment.
- Monthly retainers renew automatically unless cancelled with 14 days’ written notice.
- All payments are non-refundable, unless explicitly stated in your service agreement.
Chargebacks: Any chargeback or reversal without prior communication will be considered a breach of agreement, and legal or collection actions may be pursued.
Failure to cooperate may result in project delays or reduced performance, for which we are not liable.
- Provide timely access to accounts, assets, and approvals
- Be responsive to communication within a reasonable timeframe
- Refrain from making campaign changes without agency consultation
- Provide truthful, accurate business information
- All deliverables created by Landing Page Kingz (ads, designs, landing pages, email flows) remain property of the agency until full payment is received.
- Upon full payment, ownership rights of final, approved deliverables may be transferred to the client as outlined in the service agreement.
- We reserve the right to showcase non-confidential work for portfolio and promotional purposes.
We do not guarantee specific results or financial outcomes. While we apply best practices and industry experience, performance may vary due to external factors outside of our control, including but not limited to:
- Ad platform algorithm changes
- Market demand or competition
- Client-side website issues or product quality
- Delays in asset delivery or approvals
By using our services, you acknowledge that marketing results are not guaranteed and depend on various external variables.
Both parties agree to keep sensitive business information confidential. This includes client data, financial details, and strategies. This obligation remains in effect even after termination of service.
- Either party may terminate a monthly agreement with 14 days’ written notice.
- Project-based services (e.g., landing pages, one-time builds) are non-cancellable after payment and work commencement.
- In cases of misconduct, non-payment, or breach, we reserve the right to terminate the relationship immediately without refund.
No refunds will be issued for work already delivered, digital assets transferred, or hours logged.
Due to the strategic nature of our services, all payments are final and non-refundable, unless otherwise stated in a signed agreement.
To the fullest extent permitted by law, Landing Page Kingz shall not be liable for:
- Loss of revenue or profits
- Delays due to third-party platforms (e.g., Meta, Google)
- Data breaches caused by client-side tools
- Indirect or consequential damages
Our maximum liability under any circumstance shall not exceed the amount paid for services in the last 30 days.
- Any disputes will first be attempted to be resolved in good faith through direct communication.
- If unresolved, both parties agree to binding arbitration in the state of [Insert Your State, e.g., California].
- These Terms shall be governed by the laws of the United States and the state of [Insert State].
We may update these Terms from time to time. The latest version will always be available at https://landingpagekingz.com. Continued use of our services after updates constitutes your acceptance of the revised terms.
